Terms of Service

Version 0.1 · 10 September 2026 · AdMySpot is operated by Formada3D (Benjamin Duckworth, sole trader, ABN pending display), Melbourne, Victoria, Australia ("we", "us"). These terms are a first version and will be refined; the current version always applies.

1. What AdMySpot is (and isn't)

AdMySpot is an online marketplace. Owners list surfaces they own or control (their body, clothing, vehicle, boat, pram, pet accessories, property, equipment) as advertising space. Sponsors book a spot and supply artwork. We provide the listing pages, the booking and payment flow, and the proof-of-display process.

• We are not the advertiser, the publisher of any advertisement, an advertising agency, or a party to the agreement between an Owner and a Sponsor.
• Owners are independent: they are not our employees, agents or contractors. They decide what to accept, when to display, and how.
• Audience figures, locations and descriptions on listings are supplied by Owners. We do not verify them and they are estimates, not guarantees.

2. Who can use it

You must be 18 or older and legally able to enter contracts. You must provide a working email address. You may not list a surface you do not own or control, or a person other than yourself (no listing children, employees, or anyone without their written consent).

3. Your local rules are yours

AdMySpot is available worldwide. Laws, event rules, permit requirements, insurance conditions and advertising codes differ by country, state, council and event. By listing or booking you confirm that you know and will follow the rules that apply where the ad will be displayed, including (examples, not a complete list):

• signage and planning permits for advertisements on houses, fences, gardens, shop windows and land;
• race, event and venue rules on sponsorship, logos and ambush marketing;
• vehicle and marine rules on advertising, and telling your insurer if required;
• advertising standards and codes (for example rules on alcohol, health claims, comparative advertising, advertising to children);
• tax on income you earn through AdMySpot.

If a rule where you are prohibits a display, you must not do it, and you must cancel the booking. We may refuse or remove any listing or booking in any country at our discretion.

4. Content rules

These apply to every listing, logo, link and message on AdMySpot, in every country. Not allowed:

• gambling and betting; tobacco, vaping and nicotine; cannabis and illegal drugs;
• adult, sexual or escort services; weapons and firearms;
• political parties, candidates and campaigns; religious proselytising;
• hate, discrimination, harassment, extremist content;
• payday loans, pyramid/ponzi schemes, "get rich quick", unregulated financial or crypto promotions;
• prescription medicines, miracle health claims, weight-loss claims;
• anything that infringes someone else's trademark, copyright or image rights, or impersonates a brand;
• anything aimed at or displayed on items used by children (prams, school bags) that would not be allowed in children's advertising where you are;
• alcohol on prams, children's items, school-run listings, or where the Owner is under the local drinking age.

We remove content that breaks these rules, cancel the booking, and may ban the account. Sponsors who upload disallowed artwork are not refunded the platform fee.

5. Money

• Sponsors pay by card in US dollars through Stripe when booking. The amount is shown before payment and includes our platform fee (12% of the spot price).
• The Sponsor's payment is processed by Stripe and held pending verification: for Owners with a Stripe payout account the funds sit in that Stripe account with payouts paused; funds are released to the Owner's bank only after proof of display (section 6) and the 48-hour dispute window has passed without a valid dispute. AdMySpot does not operate an escrow service or hold client money itself.
• Owners receive payouts through a Stripe Express account (Stripe verifies identity and bank details; Stripe's Connected Account Agreement applies). Owners without a Stripe account are paid manually after release. Payout timing depends on Stripe's settlement (typically 2–7 days). Owners are responsible for any tax on their earnings and for declaring them locally.
• If the Owner never uploads proof within the booking period plus 14 days, the booking is cancelled and the Sponsor is refunded in full (including our fee).
• If a dispute is upheld, the Sponsor is refunded for the disputed period. We decide disputes in good faith on the evidence uploaded; our decision is final for the purposes of AdMySpot.
• Chargebacks, fraud or misuse may lead to account closure and recovery of costs.

6. Proof of display

Owners must upload at least one photo showing the Sponsor's artwork clearly displayed on the listed surface, during the booked period. Our upload tool records the upload time and, with permission, the device location. Proof photos are shown on the listing page and to the Sponsor. Fake, edited or reused proof is fraud: it cancels all payouts, closes the account, and may be reported.

7. Artwork and intellectual property

Sponsors keep ownership of their logos and grant the Owner and us a licence to reproduce them for the booked display and to show them on AdMySpot. Sponsors warrant they own or are licensed to use everything they upload. Owners keep ownership of their photos and grant us a licence to show them on the listing. If you believe content on AdMySpot infringes your rights, email [email protected] with the URL and details; we act on valid notices promptly and operate a repeat-infringer policy.

8. What we're not responsible for

To the fullest extent the law allows: we provide AdMySpot "as is"; we are not liable for the conduct of Owners or Sponsors, for any display not happening or happening badly, for fines, permit breaches, event penalties, insurance consequences, injuries, damage to surfaces or vehicles, or for any indirect or consequential loss. Our total liability to you for anything arising from AdMySpot is limited to the platform fees you paid us in the 12 months before the claim. Nothing in these terms excludes rights you have under the Australian Consumer Law or equivalent consumer law that cannot be excluded.

9. You cover us

You indemnify us against claims, fines, losses and costs arising from your listing, your artwork, your display, or your breach of these terms or of any law or rule that applies to you.

10. Accounts, data and privacy

There are no passwords. Your dashboard link is your login: keep it private. We store your email, listings, bookings, uploaded images and proof metadata (time, and location if you allowed it). See the Privacy Policy.

11. Changes, termination, law

We may change these terms; the version on this page applies from the date shown. We may suspend or close any listing or account that breaks these terms. These terms are governed by the laws of Victoria, Australia, and you agree to the courts of Victoria, without excluding mandatory consumer protections where you live.
